Terms of Service

Last updated: April 19, 2025

1. Acceptance of Terms

By creating a TapMD account or using any part of our platform, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use TapMD.

These Terms constitute a legally binding agreement between you and Revelation Media Inc. ("TapMD", "we", "us"), the operator of the TapMD platform, incorporated in Alberta, Canada.

2. Eligibility

You may use TapMD only if you:

  • Are at least 18 years of age, or a legal guardian acting on behalf of a minor
  • Are a resident of Alberta or British Columbia with a valid provincial health card, or are accessing private-pay services as permitted by the platform
  • Have the legal capacity to enter into a binding contract
  • Are not barred from using our services under applicable law

3. Nature of the Service

TapMD is a technology platform that facilitates virtual medical consultations between patients and independently licensed physicians. TapMD is not a medical clinic and does not itself provide medical advice, diagnosis, or treatment.

Each physician on the platform is an independent regulated health professional licensed by the College of Physicians and Surgeons of Alberta (CPSA) or the equivalent British Columbia college. The physician-patient relationship is solely between you and your treating physician. TapMD is not a party to that clinical relationship.

Virtual care has inherent limitations. Your physician may determine that your condition requires in-person assessment. TapMD is not a substitute for emergency care — in a medical emergency, call 911 or proceed to the nearest emergency department.

4. Account Registration

You must provide accurate, current, and complete information when creating your account, including your legal name, date of birth, and valid provincial health card number. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at support@tapmd.ca if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts where we suspect fraud, misrepresentation, or breach of these Terms.

5. Appointments and Cancellations

Appointments booked through TapMD are subject to physician availability. We will make reasonable efforts to connect you with your chosen physician at the scheduled time; however, we cannot guarantee availability due to clinical emergencies or technical issues beyond our control.

You may cancel or reschedule an appointment through the platform. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee where applicable under the billing type selected.

6. Billing and Payment

6.1 Insured Services (AHCIP / MSP)

For services covered by Alberta Health Care Insurance Plan (AHCIP) or British Columbia Medical Services Plan (MSP), billing is submitted on behalf of your physician directly to the provincial health authority. No direct payment is required from you for insured services, subject to your provincial eligibility.

6.2 Private-Pay Services

For services not covered by a provincial plan, fees will be disclosed before you confirm the appointment. Payment is processed securely through our payment processor. All fees are in Canadian dollars.

6.3 Platform Fee

TapMD charges a platform fee on physician billings to fund platform operations. This fee is disclosed to physicians and does not affect the amount billable to provincial health authorities or charged to patients for private-pay services.

7. Your Conduct

You agree not to:

  • Provide false or misleading information about your identity, health status, or health card
  • Use TapMD for any purpose other than seeking or facilitating legitimate medical care
  • Attempt to access another user's account or health information
  • Use the platform to harass, threaten, or abuse any physician, staff member, or other user
  • Attempt to reverse-engineer, scrape, or interfere with the platform's technical infrastructure
  • Use TapMD in violation of any applicable law or regulation

8. Intellectual Property

All content on the TapMD platform — including software, design, trademarks, and text — is owned by or licensed to Revelation Media Inc. and is protected by Canadian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

Your clinical records and health information belong to you. A copy of your records is available on request in accordance with our Privacy Policy.

9. Disclaimer of Warranties

The TapMD platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted access. We do not warrant that the platform will be error-free or that any defects will be corrected.

We do not make any warranty regarding the medical advice, diagnosis, or treatment provided by physicians on the platform. Physicians are independent professionals and TapMD is not responsible for their clinical decisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Revelation Media Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or your use of TapMD shall not exceed the greater of (a) the amount you paid to TapMD in the 12 months preceding the claim, or (b) CAD $100.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Revelation Media Inc. and its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the platform, or your violation of any applicable law.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of TapMD shall be subject to the exclusive jurisdiction of the courts located in Edmonton, Alberta. You waive any objection to the exercise of jurisdiction by these courts.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Material changes will be communicated by email or prominent platform notice at least 14 days before they take effect. Your continued use of TapMD after the effective date constitutes acceptance of the updated Terms.

14. Termination

You may close your account at any time by contacting support@tapmd.ca. We may suspend or terminate your account immediately if you breach these Terms or if required by law. Clinical records will be retained in accordance with our Privacy Policy and applicable retention requirements even after account closure.
